How truck crash cases work in New Jersey

A truck case mixes New Jersey injury law with federal trucking rules. These are the points that shape most claims. However, they are simplified, and your own deadline depends on your facts.

Two years to file

First, most New Jersey injury lawsuits must be filed within two years of the crash. A wrongful death claim also generally has two years from the date of death.

However, if the truck belonged to a town, county, the state or an authority such as the Turnpike Authority, a written notice of claim is generally due within 90 days.

The 51% bar

You can recover if you were not more than 50% at fault. However, any award is reduced by your share of the fault. For this reason, trucking insurers often argue this point hard.

Your own policy still matters

First, your own PIP coverage pays your medical bills. In addition, if your auto policy has the limitation-on-lawsuit option, the verbal threshold applies to your pain and suffering claim even when a truck caused the crash.

Hours-of-service limits

Property-carrying drivers may drive up to 11 hours within a 14-hour window after 10 hours off duty. Electronic logs also show whether a driver broke these limits.

Evidence has a shelf life

In fact, carriers only have to keep driver logs and supporting records for six months. Post-crash alcohol tests are also due within 8 hours and drug tests within 32 hours. As a result, a prompt preservation letter protects what the carrier is not required to keep.

In addition, interstate carriers must carry federal minimum liability insurance under 49 C.F.R. Part 387, which is set well above New Jersey's minimums for private cars. That coverage, plus the chance that the carrier, the broker, the shipper or a maintenance shop shares fault, is also a big reason truck cases are handled differently. When will you send a preservation letter?

Driver logs, dash camera footage and engine data can be lost or overwritten. For this reason, ask how quickly the firm puts the carrier on notice to keep them.

Who will handle my case day to day?

For example, ask whether the attorney you meet will be the one working your file, or whether it will be passed to someone else.

Which experts do you use on truck cases?

Most serious truck cases need an accident reconstructionist and, in many cases, a trucking safety expert. Also ask who the firm works with and who pays for them up front.

How are case costs handled?

First, New Jersey caps contingency fees under Court Rule 1:21-7. Ask whether costs come out before or after the fee is calculated. Then ask what happens to costs if there is no recovery.

Have you litigated against interstate carriers?

Cases against out-of-state trucking companies are sometimes moved to federal court. For that reason, ask whether the firm has handled cases there.

The Supreme Court of New Jersey certifies attorneys who meet its trial experience, peer review and exam requirements. However, it is one fact to weigh, not a guarantee of any result.

Questions about New Jersey truck accident law firms and claims

How long do I have to file a truck accident lawsuit in New Jersey?

In general, most people have two years from the date of the crash under N.J.S.A. 2A:14-2. However, if a government vehicle was involved, a notice of claim is generally due within 90 days. However, deadlines have exceptions, so have an attorney confirm yours.

Who can be held responsible for a truck crash in New Jersey?

Besides the driver, possible defendants also include the trucking company, the truck or trailer owner, a freight broker, the shipper or loader, a maintenance shop and a parts manufacturer. In each case, which ones apply depends on what caused the crash.

Does the verbal threshold apply if a truck hit me?

It can, because the threshold comes from your own auto policy. If you chose the limitation-on-lawsuit option, you must show an injury in one of six categories under N.J.S.A. 39:6A-8(a) to recover for pain and suffering, even when a commercial truck was at fault.

What if the truck belonged to a town, county or the Turnpike Authority?

Claims against public entities fall under the New Jersey Tort Claims Act. A written notice is generally due within 90 days. In addition, there are extra limits on what you can recover. For example, garbage trucks, public works trucks and some buses fall into this group.

How much does a New Jersey truck accident lawyer cost?

Most injury firms work on contingency, so there is no hourly bill. Court Rule 1:21-7(c) caps the fee at 33⅓% of the first $750,000 recovered, then 30%, 25% and 20% on each next $750,000. Also, a fee on amounts above $3 million requires court approval. Therefore, ask how case costs are handled before you sign.

Is an 18-wheeler accident the same as a truck accident?

Yes. An 18-wheeler, big rig, semi-truck and tractor-trailer all describe a tractor pulling a trailer. However, box trucks, dump trucks and delivery vans are also commercial trucks, and many of the same federal rules can apply to them.

Do I need a truck accident attorney or a car accident lawyer?

Any injury lawyer can take a truck case. However, truck cases add federal trucking rules, commercial insurance and more defendants, so it helps to ask whether the attorney has handled New Jersey 18-wheeler or big rig cases before.
